NOTICE IS HEREBY GIVEN, that a public hearing of the qualified voters of the Cheektowaga-Sloan Union Free School District, Erie County, New York will be held in the Irma Czubaj Board Room at said district on Tuesday, May 11, 2010 at 7:00 pm at which all interested persons will be heard.

NOTICE IS HEREBY GIVEN, that the voting shall be held on Tuesday May 18, 2010 at the John F. Kennedy High School, 305 Cayuga Creek Road, Cheektowaga, NY 14227, County of Erie, State of New York at which time the polls will be open between the hours of 12 noon and 9:00 p.m., prevailing time to vote by machine upon the following items:

1. To adopt the annual budget of the Cheektowaga-Sloan Union Free School District for the fiscal year 2010-2011 and to authorize the requisite portion thereof to be raised by a tax on the taxable property of the District.

2. To elect two (2) members to the Board, two for a five (5) year term commencing July 1, 2010 and expiring on June 30, 2015, currently held by Debra Smith. and Ceil Grzybek.

AND FURTHER NOTICE IS HEREBY GIVEN that a copy of the statement of the amount of money which will be required to fund the School District’s budget for 2010-2011 exclusive of public monies, may be obtained by any resident of the District during business hours beginning Tuesday, May 4, 2010 to May 18, 2010 at the Office of the Director of Finance and Administrative Services, 166 Halstead Ave., Sloan, NY.

AND FURTHER NOTICE IS HEREBY GIVEN that petitions nominating candidates for the office of members of the Board of Education shall be filed with the Clerk of said School District at the Clerk’s office in the Administrative Offices of the School District, 166 Halstead Ave., Sloan, NY not later than April 19, 2010, between 8:00 a.m. and 5:00 p.m. Each petition shall be directed to the Clerk of the District. Education Law Section 2018(a) states nominating petitions must be signed by at least 25 qualified district voters or 2% of the number of voters who voted in the previous annual election of the members of the board of education, which every is greater.

The petition must state the name and residence of the candidate, and name and address of the signatures, and shall describe the specific vacancy for which the candidate is nominated.

AND FURTHER NOTICE IS HEREBY GIVEN that the qualified voters of the School District shall be entitled to vote at said annual vote and election. A qualified voter is one who is (1) a citizen of the United States of America, (2) eighteen years of age or older, (3) resident within the School District for a period of thirty (30) days next preceding the annual vote and election, and (4) is not otherwise prohibited from voting pursuant to the Election Law. The School District may require all persons offering to vote at the budget vote and election to provide one form of proof of residency pursuant to Education Law Section 2018-c. Such form may include a driver’s license, a non-driver identification card, a utility bill, or a voter registration card. Upon offer of proof of residency, the School District also requires all persons offering to vote to provide their signature and printed name and address.

AND FURTHER NOTICE IS HEREBY GIVEN that applications for absentee ballots for the purposes of voting on all propositions and election of two (2) Board of Education members, may be applied for at the office of the District Clerk. A list of all persons to whom absentee ballots have been issued will be available in the office of the District Clerk, on each of five (5) business days prior to the vote and at the polling place on the day of the vote.

AND FURTHER NOTICE IS HEREBY GIVEN that pursuant to a rule adopted by the Board in accordance with 2035 and 2008 of the Education Law, copies of which are available at the office of the District Clerk any referenda or propositions to amend the budget, otherwise to be submitted for voting at said election, must be filed with the Clerk of the Board of Education on or before April 19, 2010 at 5:00 p.m. prevailing time; must be typed or printed in English, must be directed to the Clerk of the School District . Education Law Section 2018(a) states nominating petitions must be signed by at least 25 qualified district voters or 2% of the number of voters who voted in the previous annual election of the members of the board of education, which every is greater. The petition must state the name and residence of the candidate, and name and address of the signatures, and shall describe the specific vacancy for which the candidate is nominated. However, the School Board will not entertain any petition to place before the voters any proposition the purpose of which is not within the powers of the voters to determine, or any other business as is authorized by law.

TAKE FURTHER NOTICE, that the election of members of the Board of Education shall be held to fill two (2) at-large positions on the Board. The two candidates receiving the highest vote totals shall each be elected to three-year terms (commencing July 1, 2010 and ending June 30, 2013) to fill the vacancies created by the expiration, on June 30, 2010, of the terms of Mrs. Natalie Schaffer and Mr. Donald Sniezak.

TAKE FURTHER NOTICE, that all candidates for the office of Member of the Board of Education shall be nominated by petition. Each petition shall be directed to the Clerk of the District, shall be signed by at least forty-three (43) qualified voters of the District, shall state the name and residence of the candidate, shall state the residence of each signer, and shall be filed in the office of the Clerk of the District between the hours of 9:00 o’clock a.m. prevailing time and 5:00 o’clock p.m. prevailing time not later than April 19, 2010.

2010-11 BASIC BUDGET

Shall the following resolutions be adopted, to wit:

RESOLVED, that the basic budget for the Orchard Park Central School District (the “District”) for the fiscal year commencing July 1, 2010 and ending June 30, 2011, as presented by the Board of Education, is hereby approved and adopted and the required funds therefore are hereby appropriated and the necessary real property taxes required shall be raised by a tax on the taxable property in the District to be levied and collected as required by law.

PROPOSITION NO. 2 - PURCHASE

AND FINANCING OF VEHICLES,

RELATED EQUIPMENT

AND SUPPLIES

Shall the following resolutions be adopted, to wit:

RESOLVED, that the Board of Education (the “Board”) of the Orchard Park Central School District (the “District”) is hereby authorized to purchase vehicles and related equipment and supplies for use in the transportation program of the District, including: (i) three (3) sixty-five (65)-passenger school buses at a maximum estimated cost of $104,000 each, two (2) thirty (30)-passenger van-type buses at a maximum estimated cost of $71,500 each, two (2) universal wheel chair van-type buses at a maximum cost of $61,000 each, and one (1) van/car at a maximum estimated cost of $23,000; and be it further

RESOLVED, that the sum of $600,000, being the total of the aforesaid maximum estimated costs, shall be funded (subject to the terms set forth herein) by the imposition of a tax which is hereby authorized to be levied and collected in installments in such years and in such amounts as shall be determined by the Board and, in anticipation of such tax, (i) bonds or other obligations of the District are hereby authorized to be issued and (ii) the District shall be authorized to enter into lease or lease/purchase arrangements (having a term of up to five years) if approved by the Board of Education in accordance with applicable statutes and regulations; and be it further

RESOLVED, that the tax authorized hereby shall be in an amount sufficient to include the interest on such bonds or other obligations (or the interest component under any lease/purchase arrangements) as the same shall become due and payable; and be it further

RESOLVED, that in order to offset the tax hereby authorized, and to completely or substantially eliminate the need for its actual imposition, an amount sufficient to pay the principal of and interest payments on the bonds or other obligations herein authorized, or to make the required payments under any lease or lease/purchase arrangements entered into, up to a maximum of $600,000 plus interest required, shall be obtained and so applied from the following sources: (i) all State transportation aid received by the District in connection with the District’s purchase of transportation vehicles during the 2010-11 school year, which aid, until so expended, is to be deposited in the District’s existing Transportation Equipment Reserve Fund that was authorized to be established on June 8, 1984 (the “Transportation Reserve”) and (ii) up to $150,000 in available funds of the District; and be it further

RESOLVED, that the following specific transfers from the Transportation Reserve, having been generally authorized in previously adopted propositions for the purchase estimated cost of $104,000 each, two (2) thirty (30)-passenger van-type buses at a maximum estimated cost of $71,500 each, two (2) universal wheel chair van-type buses at a maximum cost of $61,000 each, and one (1) van/car at a maximum estimated cost of $23,000 (b) that a tax is hereby authorized in an amount of up to $600,000 to finance the direct costs of such purposes, such tax to be levied and collected in installments; (c) that such tax shall be in an amount sufficient to include the interest on such bonds or other obligations (or the interest component under any lease/purchase arrangements) referred to herein, (d) that in anticipation of such tax, (i) bonds or other obligations of the District are hereby authorized to be issued and (ii) the District shall be authorized to enter into lease or lease/purchase arrangements having a term of up to five years; (e) that an amount sufficient to pay all of the expenditures authorized hereunder, up to a maximum of $600,000 plus interest required, shall be obtained from the following sources, so as to completely or substantially eliminate the need for the actual imposition of the tax herein authorized: (i) all State transportation aid received by the District in connection with the District’s purchase of transportation vehicles during the 2010-11 school year, which aid, until so expended, is to be deposited in the District’s existing Transportation Equipment Reserve Fund (the “Transportation Reserve”) and (ii) up to $150,000 in available funds of the District; (f) that $135,540 in specific transfers from the Transportation Reserve, having been generally authorized in previously-adopted propositions for the purchase of vehicles currently owned by the District, are hereby explicitly authorized to be made prior to the expiration of the 2009-10 fiscal year of the District and (g) that the stated funding sources, ultimate amounts and purposes of the Transportation Reserve are hereby amended to the extent sufficient to permit such transfers and applications of funds as described herein.

TAKE FURTHER NOTICE, that a public hearing for the voters of the District on the District’s 2010-11 budget and expenditure of funds will be held on May 4, 2010 commencing at 7:00 o’clock p.m. prevailing time at the District Office Conference Center, 3330 Baker Road, Orchard Park, New York.

TAKE FURTHER NOTICE, that voting machines will be used to record the vote on the budget, the vote on the election of members of the Board of Education and the vote on the various propositions presented.

TAKE FURTHER NOTICE, that the Board of Education of the District has adopted Rules for the Use of Voting Machines and the Submission of Questions or Propositions to be Placed Thereon. Printed copies for general distribution in the District are available at the office of the District Clerk located in the District Offices, 3330 Baker Road, Orchard Park, New York.

TAKE FURTHER NOTICE, that applications for absentee ballots for the Annual District Vote may be applied for at the office of the Clerk of the District. A list of all persons to whom absentee ballots shall have been issued will be available in the office of the District Clerk on each of the five business days prior to the Annual District Vote. Completed applications must be received by the District Clerk no later than seven (7) days before the election if the ballot is to be mailed to the voter, or no later than the day before the vote if the ballot is to be personally delivered to the voter. Absentee ballots must be received by the District Clerk no later than 5:00 p.m., prevailing time, on May 18, 2010.
